DECISION ON OFFICIAL INFORMATION REQUEST
 
I refer to your official information request dated 17 June 2025 for the
 Bluff Reserve account funding permitted use.
 
The information you have requested is as follows:
 
Use of reserve funds
The reserve held is deemed as a non restricted reserve as it does not meet
 the conditions to be classed as a restricted reserve.  As a non restricted
 reserve, the funds do not have any restrictions of use however as they
 were generated from ratepayers from Bluff, Council’s intention is that the
 reserve is used towards projects in Bluff or held to cover any future
 deficits from the board. 
 
Why funds are not Restricted Reserves
Restricted Reserves are grouped into three categories
o Legal Restriction - The restriction is designated from a statute or a
 legal document
 o Capital-only restriction – These reserves are invested in property
 that provides a financial return to ratepayers
 o Specific purpose – These reserves have been accumulated from users
 and/or ratepayers for a specified purpose and from which Council is
 bound to provide a service in the future
 
As the funds held in the Bluff community board reserve is generated from
 surplus/deficit funds from the Bluff community board targeted rate and the
 targeted rate is set to fund the cost of the Bluff Community Board
 operations and its projects, it does not meet the definition as a
 restricted reserve.

o Invercargill City Council Revenue and Financing Policy: This policy
 outlines the requirements to meet the Local Government Act 2022
 Section 103 for funding operating and capital expenditure.

We have looked into your questions and I have outlined answers below:
 
Could you please clarify what clause/s of the Resource Management Act 1991
 are relevant with regard to my request?
The Resource Management Act 1991 provides a framework that influences how
 funds are used and is considered as part of all reserves funds of Council.
For example Clause 409 Financial contributions for developments. 
 
Currently there is no clauses in this Act that are connected to existing
 funds held by the Bluff Community Board in its reserves but in the future
 there could be.
 
Is there a reason why the Local Government (Rating) Act 2002 is not
 considered relevant? 
The Rating Act focuses on the “who from” and “how” Council gathers rates
 revenue from the ratepayer.  It does not focus on the how funds are
 contributed to reserve funds or how they can be used.
