Kiwibuild home late delivery exemption

Dear Kāinga Ora–Homes and Communities,

If a Kiwibuild home was purchased in December 2020 and its delivery was postponed by the developer for 2.5 years, the homeowner is required to occupy the residence for 3 years, totaling approximately 6 years before selling.

Are there any exemptions for homes that are handed over more than 2.5 years later than the originally scheduled settlement date?

Kiwibuild/Kāinga Ora is not responsible for determining the sunset clause, setting the delivery date, ensuring the developer's capacity to deliver homes on time, or permitting sales in cases where delays occur due to the developer's fault, even if the buyer's circumstances change.

Dear Raja

 

I refer to your request to Kāinga Ora – Homes and Communities, dated 25
March 2024, requesting the following information under the Official
Information Act 1982 (the Act):

 

If a KiwiBuild home was purchased in December 2020 and its delivery was
postponed by the developer for 2.5 years, the homeowner is required to
occupy the residence for 3 years, totaling approximately 6 years before
selling.

 

Are there any exemptions for homes that are handed over more than 2.5
years later than the originally scheduled settlement date?

 

You can expect to be notified of the decision on your request by 24 April
2024 at the latest, being 20 working days after the day on which the
request was received by Kāinga Ora in accordance with section 15(1) of the
Act.

 

If an extension of time is required to make a decision you will be
notified prior to that date in accordance with section 15A of the Act.

 

We may also contact you if further clarification or refinement of your
request is required to enable a decision to be made.
