New Zealand Police
Dear JennyM
Thank you for your request in which you asked "what constitutes Police
business".
Police business is wide-ranging. Section 9 of the Policing Act 2008 states
that the functions of Police include:
· (a) keeping the peace:
· (b) maintaining public safety:
· (c) law enforcement:
o (d) crime prevention:
o (e) community support and reassurance:
o (f) national security:
o (g) participation in [1]policing activities outside New Zealand:
o (h) emergency management.
Further information about the work of NZ Police can be found on the Police
website [2]http://www.police.govt.nz/ and in documents published on that
website such as Police annual reports.
If you require specific information about an aspect of Police business,
please advise.

Dear MCMAHON, Teresa,
Thank you - please could you tell me into which category of Section 9 Police Act the following then falls.
An OIA sent to Police by another agency undertaking an investigation (no charges laid) for private information held in an employment file (not an OIA matter).
NZ Police had NO consent to release to that information to any other agency, (advice of no consent was written months prior and sent to and received by HR including the instruction that should any such request be received the NZ Police MUST IMMEDIATELY INFORM [the subject] which they did not), and after two months the request was declined, with the response to the requester being "because we have no consent".
Additionally the request was entered under the requester's name only, not the agency, and had no link to the subject whose information was sought, preventing them from ascertaining if there was any information requests or investigations.
NZ Police knew they had no consent, and knew they had to inform the subject immediately yet they failed to do so. After being questioned on the error of this and other errors in the handling of the matter, suddenly it became "because it was Police Business."
Why does this become "Police Business"?
How can it be not Police Business AND Police Business - it cannot be both.
Yours sincerely,
JennyM
