Dear Wellington City Council,

The other day Tory Whanau was on Newstalk ZB and I quote had the following responses verbatim

A response to what will the impact on business be - the mayors answer was as follows

"Engagement hadn't been done that well"

A response to the two year construction period

"Some businesses don't survive"

I note the Mayors first quote effectively puts Wellington City Council in breach of the Local Government Act 2002 Section 82 "Principles of Consultation"

Please provide as follows

- Consulation assessment to include where available - assessment of consulation, written responses for and against project, total number of written submissions for the project, total number of written submissions against event, submissions to be attached in PDF, total number of businesses impacted, total number of businesses that WCC sat down with - to include dates, business, memo of meeting, cost / benefit analysis, total number of commercial landlords impacted, total number of commercial landlords that WCC sat down with - to include dates, landlord, memo of meeting, total number of maori consulted that WCC sat down with - to include dates, names, memo of meeting

Please include all attachments in PDF form where available specifically the meetings with impacted parties and the notes associated

I also note as per the mayors comment this project appears to be in breach of the Local Government Act in a number of ways. Noting that this project appears to going to be litigated please provide any and all legal memos, notes, advice prior to litigation and now.

Please provide the law firm engaged on behalf of WCC and the costs to date itemised with what the cost is associated with.

On 26 January 2024, Wellington City Council partially transferred the
following part of your request to NZ Transport Agency Waka Kotahi for
response:

engagement/consultation have been undertaken since 2019, as listed below:

o Late 2019 – Public engagement on project vision
o Mid 2020 – Public consultation on options: Streamline, Prioritise, and
Transform
o February/March 2022 – Early engagement with business owners/ managers,
and residents about how they use the space
o July/August 2022 – Stakeholder and public engagement on the 30%
detailed design
o April/May 2023 – Stakeholder and public consultation on proposed
traffic resolutions

 

As such, the scope of your request as it stands would require a
significant collation of information and we may consider refusing the
request on the basis that the request cannot be met without substantial
collation or research.

 

We would like to invite you to narrow down the scope of your request by
specifying the engagement/consultation round that you are most interested
in.
