Request for video footage from Ngongotaha Village security cameras

Dear Rotorua District Council,
Please may I request access to the video recording made by the Ngongotaha Village surveilance camera's on Friday 9th September 2023 between the times of 16.30 and 17.30, in particular footage from the junction of Taui Street, Hall Road and Ngongotaha Road.
This relates to a police incident 230909/0148 - I was knocked off my bicycle by a motorist and I wish to review the events in order to decide whether or not to proceed with a civil case for this. I have also requested a copy of the above report from the police and made a complaint to the IPCA.

I refer to your Official Information request for video recording made by
the Ngongotaha Village surveillance cameras on Friday 9 September 2023
between the times of 16:30 and 17:30, in particular footage from the
junction of Taui Street, Hall Road and Ngongotaha Road.
Council operates CCTV in public spaces for the purposes of security and
safety. Council shares CCTV information and footage to the Police where
criminal activity has occurred to support any investigations.
Council does not provide video recordings from CCTV cameras to members of
the general public as per Privacy Principle 11 (s22) and s53(b)(i) of the
Privacy Act, and s7(2)(a) of the Local Government Official Information and
Meetings Act. Your request is therefore declined under these clauses.
Your request should be directed to the Police who can then seek footage
from Council.
You have the right to seek an investigation and review by the Ombudsman of
this response/decision. The Ombudsman’s Office can be contacted by calling

Wellington 6143.

I have discussed your further request with our Privacy Officer and
Council’s position still stands. Council does not release CCTV camera
footage to members of the general public due to privacy. If there is a
potential case to be brought for dangerous driving, the Police can request
footage as part of their investigation.
Your request is declined under Privacy Principle 11 (s22) and s53(b)(i) of
the Privacy Act, and s7(2)(a) of the Local Government Official Information
and Meetings Act.
