Why has CCC not taken over ownership of the roads - Firefly Place, Walrus Road, Wasp Road & Tiger Moth Road - located within the CIAL precinct?
If the roads are indeed privately owned (by CIAL, not CCC), how then could the Waimāero/Fendalton-Waimairi-Harewood Community Board make a binding decision on 18 November 2019 to approve the issuance of these names?

following information, under the Local Government Official Information and
Meetings Act 1987 (LGOIMA):
“Why has CCC not taken over ownership of the roads - Firefly Place, Walrus
Road, Wasp Road & Tiger Moth Road - located within the CIAL precinct?
If the roads are indeed privately owned (by CIAL, not CCC), how then could
the Waimâero/Fendalton-Waimairi-Harewood Community Board make a binding
decision on 18 November 2019 to approve the issuance of these names?”.
Please find below a response to your LGOIMA request.
A road can be publicly owned by Council (most roads are public) and they
are typically created via a subdivision process where the road is
specifically vested in Council. Other legal processes can also apply.
A road can also be privately owned by an individual landowner and not
vested in Council like at the airport. The process to physically form a
private road is under section 348 of the Local Government Act 1974 (LGA).
To most people a private road and a public road would not look that
different as Council engineers generally apply the same formation
standards.
Section 319A of the LGA sets out that Council must inform LINZ of road
names.
Section 319B of the LGA sets out the requirements for allocating property
numbers to a building or lot.
Roads (private or public) will often have buildings and lots adjoining
that need to have an address. To create an address, the private or public
road needs a unique road name that cannot be confused with other road
names (private or public). The authority to make that decision lies with
the Community Boards as opposed to private landowners. Private right of
ways also needs to be named once there is more than 6 primary
addresses/lots/dwellings.
The naming of a private road by the community board does not make that
road a public road.
