Thank you for request to the Ministry of Justice of 7 June 2023 seeking,
under the Official Information Act 1982 (the Act) court information. 

 

Specifically, you requested court files/records for the case
CIV-2022-404-2203 that was heard by the High Court at Auckland on 2 March
2023.

 

While the Act binds the executive arm of government (Ministers, government
agencies), the courts are a separate and independent arm of government and
are excluded from its ambit by section 2(6)(a).  The information you are
seeking is court information, therefore, I must refuse your request under
section 18(g) of the Act on the grounds that the information is not held
by the Ministry or any other agency subject to the Act.

 

If you want to request court information, you need to apply to the High
