Kia ora dMedia. Your request for information submitted by email on 20
October 2022 under the provisions of the Local Government Official
Information and Meetings Act (LGOIMA)1987 for body camera footage from
Michelle Lexmond for the past three months is refused under the following
grounds:
· section 7(2)(a) to protect the privacy of the persons recorded
in the footage
· section 7(2)(f) to maintain the effective conduct of public
affairs through:
(i) the free and frank expressions of opinions to officers of the local
authority in the course of their duty
(ii) the protection of an officer from improper pressure of harassment.
· Section 6(a), as the release of the information would be likely
to prejudice the maintenance of the law, including the prevention,
investigation, and detection of offences, and the right to a fair trial.
This is because the footage may be used as evidence in investigations and
court proceedings.
Your request for information regarding incident reports generated the
actions of this employee has also been refused under section 7(2)(a).
You have a right under section 27(3) of LGOIMA to make a complaint to the
Ombudsmen about the refusal to provide the requested information set out
in this email.
