- Theft

For each of the Police Manual chapters listed above, please release the following information:
a. A copy of the latest version of the document.
b. The date on which the current version of the document came into effect.
c. The next planned review date of the document.
d. The licence under which the document and any accompanying information is released.

If possible, I would prefer that the information be released under the Creative Commons Attribute 4.0 licence (CC BY 4.0) [1], which is recommended under the NZGOAL framework [2]. Cabinet has invited NZ Police to take NZGOAL into account when releasing copyright material and non-copyright material to the public for re-use [3].

If NZ Police decides to refuse my request under section 18(d) of the Official Information Act 1982 because the information will soon be publicly available, I ask that you also provide me with some detail as to the plan for when these documents will be made publicly available.

Please provide this information in an accessible, searchable format without a watermark.

If any information needs to be withheld from a document, please ensure this is not done in a way that makes the surrounding content (such as other content on the same page) inaccessible.

I have been asked to advise you that Police requires an extension of time
in which to respond to your request, pursuant to section 15A(1) of the
Official Information Act 1982 (OIA). Specifically, section 15A(1)(b),
consultations necessary to make a decision on the request are such that a
proper response to the request cannot reasonably be made within the
original time limit.

 

Police requires until 16 December 2022 to provide a substantive response
to your request. We are endeavouring to provide this to you as soon as
possible.

You have the right, under section 28(3) of the OIA, to make a complaint to
an Ombudsman about this extension.

I wish to request further information/clarification with regards to the documents in my original request. I assume that given the time extension you require this should not be an issue. I do not intend this to be perceived as a separate OIA request.

1. If any information is withheld under section 6 of the Act, please provide both the reason for the removal of the information as well as the grounds in support of that reason as outlined by section 17(2)(b) of the Act.
2. Please release each listed Police Manual chapter as a separate document (i.e. not attached to the response letter).

Thank you for the documents and releasing them to me before the date specified in the extension.
Some information was withheld as noted in the response letter, where you said:

"[...] making available of the information is likely to prejudice the maintenance of the law including the prevention, investigation and detection of offences and the right to a fair trial."

While I'm sure that is correct, I am interested in knowing how the NZ Police comes to such conclusions, which is why I also requested the grounds in support of any reasons for refusal of information as also noted in the response letter. Section 17(2) of the OIA states that the grounds should be provided when requested.

I do not believe the released letters contains the grounds requested. Could you please release those to me?

In reply to your email querying your OIA response, as you will appreciate, it is important that Police protect its methods of investigation and detection of offences, especially when undertaking covert activity. To release this type of information would risk those committing offenses becoming familiar with Policing techniques, and makes it more likely that they will evade detection. Accordingly, this information has been withheld under section 6(c) of the OIA.

It appears you are misunderstanding what information I am requesting. I am not requesting any methods of investigation for detention of offences. I am requesting information from the NZ Police that shows that releasing the redacted information would be likely to prejudice the law.
i.e. Has the NZ Police done any research on this topic and the likelihood of released information to cause harm?

Further, you have made no effort to reply to my request through addressing specific sections of redacted information where the release of grounds for withholding such information is certainly not likely to have an impact on maintenance of the law. The page numbers and document headers on pages within the document "1 IR 01 22 32446 Account takeover Policy.pdf" are redacted. The redactions made to the page numbers and headers are not consistent throughout the same document and I fail to see what risk releasing the grounds for withholding page numbers poses to evading detention.

This message is a continuation to the original OIA request IR-01-22-32446.

I understand that the NZ Police are not going to supply me with any of the grounds for withholding information as I requested. I have submitted a complaint with the Ombudsman regarding this.

However, because I received an updated copy of the Account takeover policy document with redactions removed after I inquired about them, it is clear to me that those redactions did and do not prejudice the maintenance of the law. For that reason I am reiterating my request for grounds; specifically for the redactions which were removed.

The redaction of page numbers was not proper, therefore, the grounds under which page numbers were redacted may be improper too. I am yet to receive the grounds for redactions for page numbers and headers. Please supply me with those. If they do not exist, please state so.
