Please release each of the following Police Manual chapters:
- Association Offences
- Attempts
- Banking, currency and card policy
- Calibrating road policing equipment
- Control of high-power laser devices

For each of the Police Manual chapters listed above, please release the following information:
a. A copy of the latest version of the document.
b. The date on which the current version of the document came into effect.
c. The next planned review date of the document.
d. The licence under which the document and any accompanying information is released.

If possible, I would prefer that the information be released under the Creative Commons Attribute 4.0 licence (CC BY 4.0) [1], which is recommended under the NZGOAL framework [2]. Cabinet has invited NZ Police to take NZGOAL into account when releasing copyright material and non-copyright material to the public for re-use [3]. If NZ Police decides to release the documents with licenses of "Not Applicable", please state whether NZ Police owns the copyright to the documents and if not, who does.

If NZ Police decides to refuse my request under section 18(d) of the Official Information Act 1982 because the information will soon be publicly available, I ask that you also provide me with some detail as to the plan for when these documents will be made publicly available.

Please provide this information in an accessible, searchable format without a watermark.
Please release each listed Police Manual chapter as a separate document (i.e. not attached to the response letter).

If any information needs to be withheld from a document, please ensure this is not done in a way that makes the surrounding content (such as other content on the same page) inaccessible.
Please provide both the reason for the removal of the information as well as the grounds in support of that reason as outlined by section 17(2)(b) of the Act.

I refer to your request of 8 November 2022 for the following information:

 

Please release each of the following Police Manual chapters:

- Association Offences

- Attempts

- Banking, currency and card policy

- Calibrating road policing equipment

- Control of high-power laser devices

 

For each of the Police Manual chapters listed above, please release the
following information:

I have been asked to advise you that Police requires an extension of time
in which to respond to your request, pursuant to section 15A(1) of the
Official Information Act 1982 (OIA). Specifically, section 15A(1)(b),
consultations necessary to make a decision on the request are such that a
proper response to the request cannot reasonably be made within the
original time limit.

 

Police requires until 16 December 2022 to provide a substantive response
to your request. We are endeavouring to provide this to you as soon as
possible.
You have the right, under section 28(3) of the OIA, to make a complaint to
an Ombudsman about this extension.

Thank you for the response. However, there are some points I'd like addressed which were not answered or followed satisfactorily.

- "If NZ Police decides to release the documents with licenses of \"Not Applicable\", please state whether NZ Police owns the copyright to the documents and if not, who does". I do not see a response for this.
- "Please provide this information in an accessible, searchable format without a watermark". The response letter appears to be a photograph (scan), which is not searchable.
- "Please release each listed Police Manual chapter as a separate document (i.e. not attached to the response letter)". This was not done.
- "Please provide both the reason for the removal of the information as well as the grounds in support of that reason as outlined by section 17(2)(b) of the Act". Grounds were not supplied; this question was not addressed.

In relation to the ‘not applicable’ answer license terms for Police Manual
chapters are now specified on the Police website as below. This link only
went live this week so wasn’t available to add to your response last year.

Please find the chapters and response attached as separate documents for
you.  

 

You will note in the response letter it states:

All chapters have been released in full except for the one on Calibrating
road

policing equipment which has been released in part, whereby information
has

been withheld under s9(2)(a) of the OIA to protect the privacy of natural
persons.

Is it just me, or has NZ Police not attached the "Banking, currency and card policy" Police Manual chapter that they say they have released? I don't see it in either of their responses.

I also see NZ Police has marked information on page 4 of the "Calibrating road policing equipment" document as having been withheld under "s. 9(2) OIA", but that section is not a withholding ground. Rather, it is a collection of withholding grounds. NZ Police has an obligation to provide a more specific reason when they choose to withhold information.

I assume they are most likely to have intended to withhold this information under section 9(2)(a) of the OIA, since it appears likely to be contact information so could be withheld in order "protect the privacy of natural persons".
