1/ Obligation Rotorua District Council has to inform residence of any proposed 24/7 Unattended business operation in city boundary eg Laundromat and such like

2/ what Opportunity do Rotorua residence have to Query or oppose such a business

3/ Requirements the Council require such a business to have in the way of extra security eg surveillance, prevention measures for illegal activities

I refer to your information request of 12 September 2022 regarding any
obligations on Council to inform residents of any proposed 24/7 unattended
business operations, and your email of 15 September clarifying you were
referring to the Sunset Road Dairy.  Your query has been processed under
the Local Government Official Information and Meetings Act.

 

1.       Obligation Rotorua District Council has to inform residents of
any proposed 24/7 unattended business operation in city boundary eg
laundromat (Sunset Road Dairy).

 

In relation to the Sunset Road Dairy at 330 Sunset Road and from a
District Plan perspective, Council can only require a resource consent if
one is triggered under the Operative District Plan.  330 Sunset Road is
located in the Commercial 3 Zone where “Convenience retail” is a permitted
activity in accordance with Rule COMZ-R6.  The definition of Convenience
retail can be found in the Interpretation section of the District Plan and
this includes Laundry facilities.  There are no performance standards
which relate to opening hours or unattended premises so Council does not
have any control over this activity; unless it breaches the noise
standards contained in the General District Wide Matters chapter.  The
District Plan can be found on Council’s website [1]HERE.

 

There is also no requirement under the NZ Building Act 2004 (NZBA) to
inform neighbours regarding the use of a building for a laundromat. The
NZBA relates only to the building itself.

 

2.       What opportunity do Rotorua residents have to query or oppose
such a business.

 

If it is a permitted activity under the District Plan as referred to
above, there is no opportunity to oppose the business under the District
Plan or NZBA.

 

3.       Requirements the Council require such a business to have in the
way of extra security eg surveillance, prevention measures for illegal
activities.

 

The District Plan or NZBA has no control over matters such as
security/surveillance/prevention of illegal activities, particularly in
the case of a Permitted Activity.  

 

From a safety perspective, there are no specific requirements that RLC has
in regard to security, surveillance etc. We recommend that all businesses,
regardless of the type and/or operating hours, do take into account the
CPTED (crime prevention through environmental design) principals as a
common sense measure. Any observations of anti-social or criminal activity
at any location in Rotorua, should be phoned through to the Police
immediately by calling 111, or any events that have already occurred
(non-emergency) by phoning 105.
