and Meetings Act for a map of all sanctioned and known unsanctioned MTB
trails in the Whakarewarewa Forest.

 

As per the Act, you will receive a response as soon as reasonably

I refer to your Official Information request of 23 July 2022 for:

 

1.       A map of the Whakarewarewa Forest including all sanctioned MTB
trails.

2.       A map of the Whakarewarewa Forest including known un-sanctioned
MTB trails.

 

Please find attached a map of the current sanctioned MTB trails in the
Whakarewarewa Forest. These tracks are developed/maintained by the Rotorua
Trails Trust and other track building contractors in conjunction with
Rotorua Lakes Council (RLC) and Timberlands (as the property owners).

 

RLC does not record un-sanctioned MTB trails.  Timberlands have provided a
confidential map to RLC which included, amongst other information,
un-sanctioned MTB trails discovered by Timberlands while inspecting their
forest blocks.  This map is withheld by Council under the following
sections of the Local Government Official Information and Meetings Act:

-        Section 7(2)(b)(ii) – would be likely unreasonably to prejudice
the commercial position of the person who supplied or who is the subject
of the information;

-        Section 7(2)(c) – protect information which is subject to an
obligation of confidence … (i) would be likely to prejudice the supply of
similar information, or information from the same source, and it is in the
public interest that such information should continue to be supplied;

-        Section 7(2)(d) – avoid prejudice to measures protecting the
health or safety of members of the public.

 

You have the right to seek an investigation and review by the Ombudsman of
