Will Maynard made this Official Information request to New Zealand Police

The request was successful.

From: Will Maynard

Dear New Zealand Police,

Do NZ police officers have to identify themselves when asked by a member of the public? If so does it include both name and QID number?

Does NZ police acknowledge common law?

Yours faithfully,

Will Maynard

This is typical bullshit answer Police give when avoiding questions of this nature .It ridiculous they can avoid questions around their true nature and jurisdiction .

We know its bs because youre generally asking questions only police have the information to.

Ive asked this one as well and Ive had similar responses (not necessarily on FYI) .Police wont even acknowledge which NZ Acts they enforce giving the same answer .

The trick will be to reword it so it sounds less like legal advice not thou its hard with this type and not had a 2nd go yet. Or complain to the ombudsman.

Police operate in both statutory and common law jurisdiction, These are and should be separate jurisdiction but everybody within judicial branch especially lawyers & police claim, pretend, act they are the same , particularly s20 crimes Act 1961. thats like saying the coloniser NZ Government is lawful. What isnt challenged becomes normal /accepted.

Where common law is mentioned in NZ Legislation and other.

Imperial Laws Application Act

Policing - act 2008
s22 Police oath https://www.legislation.govt.nz/act/publ...

s4 Interpretation - look at `policing

s23 further provisions

Its was in the Queens oath (not sure bout new king)
https://www.royal.uk/coronation-oath-2-j...

Its in the crimes Act 1961 but its quite vague
s9 Offences not punishable

s20 General rule
https://www.legislation.govt.nz/act/publ...

s42 Breach of Peace (theirs no legal crime for it as its common law under their oath)

s59 Parental control

Crimes Act 1961 s9 offences not punishable
https://www.legislation.govt.nz/act/publ...

In summary
NZ Police recognise and operate in common law but can only arrest for breach of peace in common law per their oath . Police cannot charge and convict anyone (assuming human here) for common law crime .

Common law has been treated as harm between individuals which is why all torts are called common law torts . Its also called civil law compared to criminal legislation where police operate .

So the question is not so much do police recognise common law but is a human who does not vote and has declared himself separate from the social construct/ fictional entity the NZ Government corporation bound by any of its legislation ie can a human operate solely in common law can the police charge a man for breach of NZ legislation.

Crimes Act 1961 s20 implies they can be but this doesnt answer the question if NZ Government is legally allowed to trap someone into statutory/legal jurisdiction.

Courts become tricky because the the high court is the only jurisdiction with dual jurisdiction of statutory and common law.
https://www.courtsofnz.govt.nz/the-court...

Civil is usually referred to as statutory law . Its double speak.

NZ nor Crown is described fully ,properly or consistently in NZ legslation.

Your question is vexatious, flippant, and shows a considerable lack of respect for our judicial services, and the men and women who allocate their time to it. I would suggest a perhaps a little research and self-learning, instead of sitting back and expecting everyone else to do it for you, and you would come across less ignorant and self conceited.
