hold such authority over another man or woman and from where their

corporation sole, Dun & Bradstreet or Illion listed corporation/company or

Thank you for your request under the Official Information Act 1982 (the
Act) to the Ministry of Health (the Ministry) on 15 September 2021 for:

 

Who is the authority that issued the orders within the Covid-19 Public
Health Response Act 2020? By 'who', I mean the name of the man or woman
who authored the legislation. I ask 'who' the individual is that claims to
hold such authority over another man or woman and from where their
authority stems?

 

The person who issued the Orders is the Minister for COVID-19 Response,
Hon Chris Hipkins. The Orders are drafted by the Parliamentary Counsel
Office. Drafts of legislation, including the names of individual drafters,
are subject to legal professional privilege (section 61 of the Legislation
Act 2012), and therefore are withheld pursuant to section 9(2)(h) of the
Act.

 

The Government is acting consistently and in compliance with the New
Zealand Bill of Rights Act 1990 and Human Rights Act 1993. Human rights
matters are considered as part of the making of legal instruments as part
of the COVID-19 response, and section 5 of the New Zealand Bill of Rights
Act 1990 provides that the rights can be subject to such reasonable limits
prescribed by law as demonstrably justified in a free and democratic
