Dear New Zealand Transport Agency,
Is there a law or nzta rule that has ever stated that the operator/driver of a small passenger service vehicle has to have ownership of the vehicle to operate as a small passenger service vehicle.
Has there ever been such a rule or mandate to this effect?
If there has been one to this effect is it still in effect and if it isn't when was it repealed?

Thank you for email regarding small passenger service licence requirements
and vehicle ownership.

 

The purpose of the Motor Vehicle Register (MVR) is to identify the person
who is responsible for a vehicle, including liability for licence fees and
any fines or infringements rather than who is the legal owner of the
vehicle. Legal title to a vehicle is proven by sale and purchase
agreements or similar documentation. A change of registered person
transaction is a person's claim to be responsible for the vehicle. If you
need more information about legal ownership, we suggest seeking
independent legal advice.

Ownership of a vehicle is separate to a vehicle used in a transport
service. Section [3]30A of the Land Transport Act 1998 notes
‘requirement for vehicles’, and it does not refer to a TSL holder owning
these vehicles.
