Writ of Habeas Corpus ad Subjiciendum

Lance D. Lavery made this Official Information request to Department of Corrections

The request was partially successful.

From: Lance D. Lavery

Dear Department of Corrections,

Under the Official Information Act 1982 I require the New Zealand DEPARTMENT OF CORRECTIONS to answer the following questions...

1. What is the DEPARTMENT OF CORRECTIONS policy regarding a Writ of Habeas Corpus ad Subjiciendum application?

2. Does the DEPARTMENT OF CORRECTIONS have the "Lawful" authority to ignore the Habeas Corpus Act 2001 and do they also have the "Lawful" authority to ignore a Writ of Habeas Corpus ad Subjiciendum application?

Yours faithfully,

Lance-Desmond: Lavery

I'm in touch with several parties who have a history of making OIA requests of Corrections dept . It appears to be Corrections' standard policy to ask for an extention of time . The legal provision to extend was designed as an exception , not as standard policy .

These parties have recently complained to the Ombudsman about this . I suggest you do likewise .

Dear Info@Corrections,

Thank you for your response however I am not satisfied with the response and I will decide how to remedy my dissatisfaction after I have thought about the best way forward.

In regards to this request it is still open and needs to be satisfied.

I feel an Ombudsman review is premature at this particular stage but it will be considered during the planning process.

Yours sincerely,

Lance-Desmond: Lavery
