Dear Hutt City Council,

I wish to clarify whether people are legally permitted to fish for whitebait in the Waiwhetu Stream. I have been unsuccessful in getting this information through other channels.

The Hutt City Council Parks and Reserves Bylaw 2017 includes 6.1 (b): "No person may... remove, destroy, injure, disturb, shoot, snare, trap, or otherwise interfere with any animal in a reserve, unless using a firearm in accordance with a permission granted under clause 16.2 of this Bylaw". "Animal" is defined under the 1977 Reserves Act as including fish.

Please provide the following information:

1. What HCC considers is the legal status of the act of whitebaiting from the stream (e.g., permitted, restricted, or prohibited).

2. Which agency HCC considers responsible for monitoring compliance of any prohibition, seasonal fishing, or other restriction on the act of whitebaiting from the stream.

3. If HCC has jurisdiction, such as under the 2017 bylaw, information about how the Council has enforced the bylaw since 2017, including data on how often it has taken enforcement action.
