Dear OIA Requests,

Thank you for your enquiry.

This type of “keyword” request is not unreasonable and has been undertaken for me in many government agencies and upheld as an approach by the Ombudsman. This is for a a very limited time period and the modern search functions of email systems/databases support this - especially in large organisations such as the MoH.

However there may be some focus that I can bring to the request that will assist in minimising your work - we are all interested in using taxpayer funds efficiently.

If you can provide me with a way to contact a suitable person in the MoH by phone we can discuss and agree a focus/approach/wording that is acceptable to all.

information requested was for a large amount information and cannot be
made available without substantial collation or research. 
This is due to the fact that the Ministry is unable to complete 'keyword
searches' for all inboxes that may have mentions of Matt/Matthew Shelton
or Sue Grey or Outdoors and Freedom Party or Nanotechnology. This would be
a manual task and would require a member of staff to search through each
individual inboxes of several directorates across the Ministry, which
would be a huge undertaking and would unreasonably interfere with the
workings of the Ministry. 
 
In order to make your request more manageable, could you please attempt to
narrow the scope of your request by selecting a shorter timeframe or
specifying a particular topic? 

Please respond by COB 17 May 2022 so that we can
consider your refinement in our response to your request.

Thank you for your response. The Ministry does not believe that a phone
conversation would provide any further value or clarification and
therefore declines this invitation.  

 

To provide some context regarding the scale of your request, the Ministry
undertook a search of email correspondence containing the following key
words and timeframe you have requested:

 

Matthew Shelton, Matt Shelton, Sue Grey, Outdoors, Freedom Party,
Nanotechnology.

 

This returned 23,214 items across 1,7672 mailboxes in the Ministry.
Furthermore, this had a data volume of 51.7 GB. The Ministry is unable to
export such a significant number of items into another member of staff's
inbox as the standard size is 50GB. On this basis, the Ministry stands by
its decision to refuse your request under section 18(f) of the Act, as the
information requested cannot be made available without substantial
collation or research.

 

Under section 28(3) of the Act you have the right to ask the Ombudsman to
review any decisions made under this request. The Ombudsman may be

Dear OIA Requests,

The request was not an invitation. It was a way of ensuring that the MoH meets its obligations under the OIA Act the consult.

Any reasonable adjudication body will conclusion that the consultation must be meaningful. To date it might appear that the MoH has shown bad faith in the way it has sought to close down the consultation prematurely - as demonstrated in your need to respond after my complaint to the Ombudsman.

Your response includes no basis for the MoH’s state belief that it would provide “any further value or clarification”. Please state the basis of this belief.

In fact I have a proposition to put to you that I believe is possible to meet but due to the past behaviour my level of trust in providing this to you in writing and it being adequately considered is very low. Therefore my requirement for a meaningful consultation is that we verbally discuss and agree, then document the outcome.

This is entirely reasonable and indeed has been successful in other OIA’s.

Please confirm at your earliest opportunity. This request has been outstanding long beyond a reasonable or statutory timeframe.

Today I received a voice mail on my mobile from the OIA Services Team at the MoH seeking to talk about this unresolved OIA and the outstanding complaint lodged with the Ombudsman.

The voice mail suggested calling 0800 855 066 and asking for the OIA Services Team.

This email is to document the attempt at a verbal discussion - which is much appreciated. Today I received a voice mail on my mobile from the OIA Services Team at
the MoH seeking to talk about this unresolved OIA and the outstanding
complaint lodged with the Ombudsman.

The voice mail suggested calling 0800 855 066 and asking for the OIA
Services Team.

This email is to document the attempt at a verbal discussion - which is
much appreciated.  Unfortunately when calling the number and asking for
the OIA Services Team there is only an email address made available to the
MoH Operator and a caller is unable to be put through to a physical person

If you could call me back in the morning (Thursday 21 July) that would be
good.  Anytime up to 12 noon is likely to be the best time to successfully

 Thank you for your response. The Ministry does not believe that a phone
 conversation would provide any further value or clarification and
 therefore declines this invitation.  

  

 To provide some context regarding the scale of your request, the Ministry
 undertook a search of email correspondence containing the following key
 words and timeframe you have requested:

  

 Matthew Shelton, Matt Shelton, Sue Grey, Outdoors, Freedom Party,
 Nanotechnology.

  

 This returned 23,214 items across 1,7672 mailboxes in the Ministry.
 Furthermore, this had a data volume of 51.7 GB. The Ministry is unable to
 export such a significant number of items into another member of staff's
 inbox as the standard size is 50GB. On this basis, the Ministry stands by
 its decision to refuse your request under section 18(f) of the Act, as
the
 information requested cannot be made available without substantial
 collation or research.

  

 Under section 28(3) of the Act you have the right to ask the Ombudsman to
 review any decisions made under this request. The Ombudsman may be

Information Act 1982 (the Act). On 26 July 2022, you amended the scope of
your request following a discussion with Jan Torres (Manager, OIA Services

The Ministry has conducted a search of its database and can advise that no
record has been identified of Sue Grey/Matthew Shelton/NZ Outdoors and
Freedom Party’s submission to the Health Select Committee regarding
nanotechnology. As you may be aware, copies of submitters’ written

Pursuant to section 13 of the Act, the Ministry also conducted a search of
all submissions and advice that have been released to the public by select

Thanks for your reply and confirming that my specification of the request is acceptable to the MoH to search on.

Please review this video clip - especially the first few minutes where the participants say that they have submitted on that day 28th Jan 2022 to the health select committee. https://odysee.com/@spearhead4truth:e/Na...

They may have been making a personal appearance and speaking to a paper made previously. They state that they made revisions to their submission based on the nano tech that they had become aware of earlier in the week. Is there a:
- Record/submission from that meeting that was submitted by these attendees?
- Recording or minutes from that committee meeting?
- Notes made by the attendees from the MoH?

Notwithstanding the above, the remains parts of the OIA rewording accepted by the MoH seem to be possible to retrieve. Namely:
- MoH attendees to the committee meeting identified above on the 28th Jan 2022
- Search of the email inboxes - noting that it is now August so the search would be up to this point.

It seems from the video referenced above that there was some communication with the Director General requesting a meeting and the provision of information that was rejected. My request for the email search I anticipate would surface this information.

I hope that the above is helpful in assisting you to refine your search. I apologise that I did not find the video earlier and therefore was unable to provide the specific date. That would have made all our lives easier.

Thank you for your follow up email and please accept our apologies for not
responding sooner. 

 

As you were previously advised, Manatû Hauora has no record of any
submission from Dr Matt Shelton or Sue Grey to the Health Select Committee
regarding nanotechnology, oral or written. Therefore, this part of your
request is refused under section 18(e) of the Act, that the information
does not exist.  

 

Manatû Hauora conducted a search of the former Director-General’s inbox to
identify any correspondence referred to in your email below. Manatû
Hauora identified one email, please find this attached. Some information
has been withheld under section 9(2)(a) of the Act, to protect the privacy
of natural persons. I have considered the countervailing public interest
in release in making this decision and consider that it does not outweigh
