Enforcement of Rule R190 in the proposed Natural Resources Plan

Dear Wellington Regional Council,

There are no outstanding appeals on the proposed Natural Resources Plan (pNRP) in respect of Rules R190, R196, R197, R198 and R199.

These rules of the pNRP have the following effect:

1. Driving on the CMA to access a boatshed is not provided for in any rule on the pNPR, and therefore is an activity restricted by section 12 of the RMA.

2. Driving on the CMA for the purpose of launching or retrieving a boat is not encompassed by R190 as [(in terms of subclasue (a)] there is "a boat ramp available at the locatiy. In this regard I refer to the three ramps on the rocky platform near Vella Street. Therefore this is an activity restricted by section 12 of the RMA.

3. Driving on that part of the CMA marked Area A on Map 35 of the pNRP is explicitly excluded from R190 by sub-clause (b)(i ). Therefore, this is an activity restricted by section 12 of the RMA.

All these three activities have been observed at Titahi Bay many, many times since the consent order with Titahi Bay Residents' Association was signed on 31 March 2021.

Information requested;

- details of efforts GWRC has made (if any) since 31 March 2021 to enforce the provisions of the pNRP relating to driving on the CMA at Titahi Bay.

- this information to include: description of activity, location, date and time, investigations, enforcement action,and outcome.

- details of actions GWRC plans to undertake to enforce the provisions of the pNRP relating to driving on the CMA at Titahi Bay.
