Please find the information you requested regarding accessing Council
services and facilities [1]here.

Tasman District Council, like all public building owners, must comply with
new legislation set out by central government in respect of entry to
public buildings and community facilities.

Local Government rates are a tax on property, not a user pays system. The
rates we charge have been set to make public facilities available for use.
The use of these buildings and facilities is a choice.

As a result, regardless of the reason for an individual’s choice to not
use a facility, the liability for rates will remain.

If you are not satisfied with Council’s response, you have the right to
seek an investigation and review by the Ombudsman. Information about how
to make a complaint is available at [2]www.ombudsman.parliament.nz or
freephone 0800 802 602.

Hi.
TDC have sent me a reply and I think they replied to someone elses request rather than mine.
I asked 2 questions and they failed to answer, or provide, or even mention what I asked for.

Id like them to respond to each of the 2 questions as asked. They can maybe put 1. And then their answer and then 2. And then their answer.
No they cannot have a time extn as I need the answers now and within their alloted timeframe.

response was to your LGOIMA request.

 

In response to your questions:

 1. You can find information about what Council facilities require a My
Vaccine Pass [1]here.
 2. Council rates are a property tax and are not apportioned to
facilities.

I believe TDC have made an error in their response to question number 2.
As Councils are corporations its both illegal and unlawful for corporations to issue and gather taxes and yet here they confess to issue and gather taxes.
Theres something very wrong here.

Question 1. Has been answered.
Question 2. TDCs response does not make any legal sense and Im awaiting an honest and legal answer.

It appears you have raised a challenge to your obligation to pay rates.

Your obligation to pay rates

Rates are levied pursuant to Local Government (Rating) Act 2002. By virtue
of section 60 of that Act, you may not refuse to pay rates by claiming
they are invalid unless you bring legal proceedings in the High Court.

You have not issued High Court legal proceedings and therefore must pay
your rates as they fall due.

What happens if you don't pay your rates? 

If you do not pay your rates, Council can take action to obtain the amount
you owe. We invest time and effort into the collection of unpaid rates to
be fair to the majority of property owners who do pay their rates on
time. 

Sections 63 - 76 of the Local Government (Rating) Act 2002 allows Council
to take legal action to recover overdue rates. Ultimately, this means that
Council can demand the forced sale of the defaulting ratepayer’s property
order to recover the amount owed. This process also attracts costs,
penalties and interest.

Next steps 

Council encourages you to seek independent legal advice on the validity of
your claim.

If you wish to challenge your obligation to pay rates, you must take the
appropriate legal action.

You continued to quote the Acts which are only for persons not people.

Did you fail to provide the Law because there is NO LAW?
Or did you fail to provide the Law because you dont know its relevance?

The Law is suffice.
If you cannot provide me the relevant Law then please explain and answer the question as all youve done so far is provide Acts and Legislation and your own personal tirade which are not at all relevant to people, only persons - which are paper entities, and Im not a paper entity Im a real living woman.

NZ Land Tax was abolished in 1992.
There is currently NO Land Tax in NZ.
For TDC to call rates Land Tax is both Illegal and Unlawful as per Legislation and Law.

I'd love to see the ombudsman's reply. Please post it when you get it. The council answered both of your requests, the first one they provided you a link to the public information and the second one they said that the information does not exist, there is no break down per facility per rate payer.

It sounds like you don't like the answer that you've received rather than the council has failed to comply with the OIA. They gave you the information you requested, but you didn't like it, the ombudsman can't change that. I wonder if you're expecting the ombudsman to approve your request to not pay rates.
