Request for Official Information responded to under the Local Government and Official
Information and Meetings Act 1987 (LGOIMA) (the Act) – Reference: OIR 2122-108
Thank you for your request for information, which we received on 27 October 2021.
In your correspondence of 4 and 10 November 2021, you clarified that you wanted to receive
the following information:
Please provide all communication (internal and external) between the dates of
01 January 2021 and today, 10 November 2021, between the Kapiti Coast District
Council BCA/TA functions, Infrastructure, Property, Planning and members of the
Waikanae Chartered Club, notably Michael (Mike) Cardiff, the Chair and any officer of
Waikanae Chartered Club and Nicky Holden, or her team (Property), Shaun Mallon, or
his team (Infrastructure), Steven Cody, or his team (BCA/TA) in respect of 4 Elizabeth
Street including the possible sale and purchase of the KCDC land providing access to
the rear of number 4 (identifier 625861, Section 1 Survey Office Plan 35434) and al
communication relating to the proposed development of Number 4 Elizabeth Street,
Waikanae.
We have searched our records and we attach copies of the communications that fall within
the scope of your request.
Please note that we have excluded correspondence between the previous owner of 4
Elizabeth Street, Waikanae and the Council from the scope of this request. If you would like
this information, please let us know.
Please also note that some of the information you have requested has been withheld under
the following sections of the Act:
• 7(2)(a) – to protect the privacy of natural persons
• 7(2)(g) – to maintain legal professional privilege, and
• 7(2)(h) – to enable any local authority holding the information to carry out, without prejudice
or disadvantage, commercial activities.
In the Council's view the reasons for withholding these details are not outweighed by public
interest considerations in section 7(1) favouring their release.
