Thank you for your query.
The Planning and Strategic Transport team have provided the following:
Staff are currently working through the NPSUD directions to inform a Plan
Change to enable further intensification in the City. This plan change
will be notified by August 2022.
No decisions have been made regarding the form and locations for further
intensification; the first council decisions on a zone framework, housing
typologies and spatial areas are anticipated to made in October this year.
In regards to your specific queries about qualifying matters, walkable
catchments and rapid transit stops:
Qualifying matters
Staff are still working through what we may identify as qualifying
matters. It will include the matters specified in clause 3.32 of the NPS,
namely:
a. A matter of national importance under Section 6 of the Resource
Management Act 1991 (RMA), including:
i. Outstanding Natural Features and Landscapes;
ii. Areas of Significant Indigenous Vegetation;
iii. Sites of Waahi Tapu, Waahi Taonga, Wai, and other Taonga;
iv. Historic Heritage;
v. Natural Hazards.
b. A matter required in order to give effect to any other National Policy
Statement;
c. Any matter required for the purpose of ensuring the safe or efficient
operation of nationally significant infrastructure;
d. Open space land provided for public use;
e. An area subject to a designation or heritage order, but only in
relation to the land that is subject to the designation or heritage order;
f. A matter necessary to implement, or ensure consistency with, iwi
participation legislation;
g. The requirement to provide sufficient business land suitable for low
density uses to meet expected demand under the NPS-UD;
h. Any "other" matter that renders the prescribed intensification under
the NPS-UD inappropriate in an area.
Most of these matters are already given protection through the district
plan and so we will rely on the district plan provisions and evidence
based that informed those, to justify those as qualifying matters for the
NPSUD.
Under sub-clause (h), Council can consider other qualifying matters -
matters that render the prescribed intensification under the NPSUD
inappropriate in an area. We are currently investigating whether matters
such as earthquake recovery drivers (e.g. central city low rise urban
form), existing character areas and lack of infrastructure etc, meet the
high bar to justify use as qualifying matters.
Walkable catchments
The NPSUD does not specify what a walkable catchment should be and so
staff are currently modelling a range of scenarios to inform subsequent
decision making by Council. That will include 800m but some larger
catchment areas distances. Staff have developed a walkability model that
models walking distance and time and takes account of barriers and time
delays etc. This is a much more nuanced approach that simply adopting a
'as the crow flies' methodology.
Rapid Transit Stops
Staff consider that the City does not have any stops that currently meet
the definition of a Rapid Transit Stop. A business case for Mass Rapid
Transit is however underway, and if that work results in the
identification of 'stops' that meet the definition in the NPS, then staff
will revisit the obligations in the NPSUD to enable intensification in
those locations.
