Dear Kainga Ora Correspondence,
You are legally obliged, under section 14 of the Official Information Act, to transfer requests to another agency when you don't hold the requested information but believe that the information is held by another agency subject to the OIA. Why wasn't this done? Also, it is a fairly simple question. I was expecting a prompt answer. Don't your tenancy managers or tenancy liaison officers have this information? It seems like basic information they would need to do their jobs.

Kāinga Ora considered whether to transfer your request to the Ministry of
Social Development, however as you specifically asked ' how Kainga Ora
defines 'permanent member of household' we did not think it appropriate.
If you disagree with our decision on your information request, you can
seek an independent review by the Ombudsman.

Agencies have a legal obligation, under section 14 of the Official Information Act, to transfer requests to another agency when they don't hold the requested information but they believe that the information is held by another agency subject to the OIA.

It sounds to me like Kāinga Ora should have transferred your request to MSD, instead of asking you to make a new request to them. Refusing your request under s18(g) when they believe another agency subject to the OIA holds the information, as Kāinga Ora has done here, is not appropriate.
