Subject: Official Information request - Destruction of Birth Notice (RG-9) Document

Dear Registrar-General Mr Montgomery,

In July 2020, I wrote a letter to Birth Death and Marriages (BDM) in Wellington to require copies of my records.

In a letter I received back from BDM dated 21 July 2020 (Reference: 20200141598), BDM wrote that they were unable to supply me with my Birth Notice RG-9 as my Birth Notice was not passed to BDM by the Department of Justice and secure destruction of these forms was authorised by Department of Justice.

In a further corresponding letter I received back by BDM dated 4th August 2020, BDM wrote that my Birth Notice RG-9 was not kept but the details on my RG-9 were transferred to another paper record.

I hereby request the following information, pursuant to the Official Information Act.

1. Why was my Birth Notice RG-9 destroyed

2. Who was the individual that authorised the destruction of my Birth Notice RG-9

3. Under what law does that individual have the right to destroy my Birth Notice RG-9

4. Under what Legislation does that individual have the right to destroy my Birth Notice RG-9

5. Who is authorised to destroy my Birth Notice RG-9

6. As the details that would have appeared on my Birth Notice RG-9 still exist with BDM but on another paper record. What would prevent BDM in law or legislation to create my Birth Notice RG-9 with the details they already hold
