Thank you for your Official Information Act 1982 (the Act) request of 19
March 2020 for:
“… all cabinet papers which refer to the Treaty of Waitangi.”
The Department of the Prime Minister and Cabinet (DPMC) holds all Cabinet
papers as the Cabinet Office is a business unit within DPMC. However,
Cabinet documents belong to the portfolio Minister or Ministers that
submitted them to the Cabinet or Cabinet Committee for consideration and
DPMC is required to transfer requests for Cabinet documents to the
relevant Minister(s). For Cabinet documents from a previous
Administration, DPMC would usually transfer the request to the relevant
government department or agency for response.
There are guidelines agreed by Cabinet for policy-makers to consider the
Treaty of Waitangi/Tiriti o Waitangi in policy development and
implementation. Therefore, Cabinet papers will usually refer to the Treaty
of Waitangi in the paper even if it is to advise that no Treaty of
Waitangi implications had been identified for the matters proposed in the
paper. In the 2018/2019 year there were more than 1,600 papers considered
by Cabinet Committees and Cabinet. Because of the need to consider the
Treaty of Waitangi, the vast majority of these papers would be likely to
refer to the Treaty of Waitangi and be in scope of your request. This
covers just one year of Cabinet papers.
You have not provided any timeframe for your request and to respond to
your request would require DPMC to assess all Cabinet papers it holds
going back over all years for relevance and then consult with relevant
Ministers’ Offices and departments on transfers of each paper in scope of
your request.
Given the volume of Cabinet documents that would need to be assessed,
consulted on and transferred, I invite you to consider refining your
request. You would need to refine it by timeframe as well as considering
subject area or portfolio. Furthermore, given that DPMC would need to
transfer requests for Cabinet papers, you may wish to send your refined
request directly to the relevant Minister or department. A list of all
Members of Parliament including Ministers and their portfolios (with
contact details) can be found on the Parliament website at:
