FGC/Complaints processes

Leah Trass made this Official Information request to Oranga Tamariki—Ministry for Children

Response to this request is long overdue. By law Oranga Tamariki—Ministry for Children should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: Leah Trass

Dear Child Youth and Family,

Given that errors in note/recorded taking by CYF social workers have been identified/upheld via the complaints process and corrections added.

1.What assurances do clients have that these past allegations etc will not be used again in future given they can not be removed from client files?
2. In the situation where social workers have failed to note correctly outcomes of FGC agreements and notes can not be taken, what assurances do clients have that FGC agreements will be adhered to?
3.How many complaints regarding FGC's and failure for outcomes to be noted by social workers have been received?

Yours faithfully,

Leah Trass

Dear Ms Trass,

Please find attached a letter relating to two emails received by the
Ministry on 16 October 2013 from Leigh Baillie, former employee of PANIC,
dated 20 July 2013 requesting under the Official Information Act 1982, the
following information:

·         How many settlement payments have been paid out to families due
to CYF errors outside of the normal  complaints process but in court
proceedings?

·          Of those, how many have had suppression orders placed on them
so that amounts cannot be disclosed?

·         How much was the highest amount awarded to an individual family
in either an out of court or in court settlement?

·         How much, over the last five years, has CYF spent on legal
representation in relation to its cases?

·          How much, over the last five years, has CYF paid for others’
legal representation?

Legal Services and Child, Youth and Family have advised that they are
unable to provide a response to any of these questions without further
clarification from the requestor.

Please note contact details are provided in the attached letter. Given the
high number of requests that the Ministry has underway on behalf of PANIC,
I would appreciate it if you could contact me by 5pm on 15 November 2013
otherwise I will need to close these requests.
