Leah Trass made this Official Information request to Ministry of Social Development

Response to this request is long overdue. By law Ministry of Social Development should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: Leah Trass

Dear Ministry of Social Development,

Under the official information act, I wish to know the following in regards to CYF(Child,Youth and Family).

1. What guidelines are social workers given to insure privacy of their clients. (not the act itself)
2. To protect the rights of privacy does this include the right to discuss unproven allegations with others (as in presented by social workers during FGC's and court documents) or with other agencies or individuals distantly connected to client?
3. Does this include the right to discuss past relationships etc that are not relevant to the current case? (excluding past child abuse concerns) or would this be considered a breach to the clients right to privacy if no relevance to current case?
4. Do social workers have a guideline on how they discuss and present Allegations or concerns (unproven) with others so as not to present them in such a way that they are proven rather than unproven? If yes what is that guideline?
5. How does the ministry monitor its social workers to insure they are following guidelines of the department when presenting cases at FGC's and family court? (to insure social workers are not presenting false statements) in relation to unproven allegations and/or other presented information.

Yours faithfully,

Leah Trass

Would be interesting to see any feedback here, keeping in mind current practices within CYF of complete ignorance of Privacy Act.
