Thank you for your request for information below. The Ministry will
consider and respond to your request in accordance with the Official
Information Act 1982 (the Act).
The Act allows up to 20 working days for a response, making 31 January
2020 the latest date for our response to you. If more than 20 working
days are needed due to the potential workload involved in answering your
request, we will notify you accordingly.
Under the Official Information Act (see definition of “working day” in
section 2), the period between 25 December – 15 January are not considered
to be “working days” for the purposes of calculating the 20 working day
timeframe for proving a response under the Act.
Please note, the Ministry may publicly release on our website the response
to your request five days after you have received it. Any personal
information will be removed.
In the interim, if you have any questions about your request, please email

Tēnā koe Susan
Thank you for clarifying your request. This email is to advise you on the
next steps:
· The Ministry of Education will log and process a request from you
for information showing its rationale for proposed amendments to the
licensing and certification criteria to minimise the risk of young
children choking on food. In line with section 15(1AA) of the Official
Information Act 1982 (the Act), the deadline for a response from us to
respond to your clarified request will be 7 February 2019.
· Your request for “the evidence the Ministry of Health relied on
to substantiate its draft guidance to minimise food related choking risks
in early learning services as published on the Education Conversations
website” has been transferred to the Ministry of Health for response under
section 14(b)(ii) of the Act, as it is more closely connected to its
functions. The due date for a response will also be 8 February 2019, and
you can expect to hear from the Ministry of Health shortly. If you have
any questions in the meantime, please email [1][email address].
If you have any further questions about this email, or the status of the
part of your request being responded to by the Ministry of Education,
please email [2][email address].

Kia Ora Lorraine Monahan,
In response to your clarification request, I would like to know both of
the things you mention if that is possible.
Will I have to place an OIA to the Ministry of Health for the evidence
they have used?
Thank you for your prompt response.
