Dear New Zealand Security Intelligence Service,

On the 16th of May I emailed an Official Information Act request to you asking for a range of information. A reply was issued by the NZSIS to my request on the 15th of June. A few things in your response interested me, so I am emailing a follow up Official Information Act request to request them:

Firstly: in your reply it was mentioned that there has been a complaint to the Ombudsmen over the NZSIS which has awaited resolution since 2010. This seems like a long time for a complaint to take, and so my curiosity was raised. I would like to request under the OIA:
a) a copy of the original OIA request which prompted the complaint (with the necessary deletions to protect individual privacy)
b) any correspondence about this OIA request and follow up Ombudsmen complaint, including both correspondence inside the NZSIS, with the Ombudsmen, and with the original requester. If the amount of information is too much and would trigger either charging or an s18(f) refusal, which I imagine it easily could be given the length of time the complaint has taken, could I please just have the titles/subject matter of the correspondence so I can pick and choose the most relevant information?

Secondly: in your reply it was mentioned that there has been one OIA request response that had received a section 10 refusal. Given there was only one of these, I am curious about what could have triggered the refusal. As such can I please request a copy of the original OIA request which prompted the refusal (with the necessary deletions to protect individual privacy)?

Correspondence with the Ombudsman is not "official information". But you should be able to get a copy of the original request.

Ah, yes, that is true: I overlooked the exemption in the definition. I was just curious about what the outcome was heading towards: given the complaint has been pending since 2010 I imagine the Ombudsmen has issued a provisional view but not a final recommendation.

In saying that, given the public nature of the Ombudsmen and their casenotes/rulings, given they carry pseudo-precedent, maybe if I asked them nicely they would release a copy of their ruling?
