Effects of Mixed Ownership Model
Joshua Grainger made this Official Information request to Mighty River Power Limited
The request was refused by Mighty River Power Limited.
From: Joshua Grainger
Dear Mighty River Power Limited,
I would like to request under the Official Information Act some information about the effect of the government's upcoming "Mixed Ownership Model" reforms on Mighty River Power. Basically I'm looking for any memos, emails, reports, papers, or other documents or forms of information that Mighty River Power has assessing the effects of these upcoming reforms. This includes, but isn't limited to:
a) what the effect of not coming under the Official Information Act will be, including if any FTE staff are no longer required to deal with them
b) what the effect of private shareholders not coming under an obligation to uphold the principles of the Treaty of Waitangi will be
c) if there are less or more administrative requirements upon Mighty River Power under the mixed ownership model, and if there are, what those lesser/extra requirements are
I would also like to request any correspondence that Mighty River Power has had with the government about the mixed ownership model.
Feel free to contact me if you want me to clarify my request. Thank you for your time.
Yours faithfully,
Joshua Grainger

Dear Mr Rockwell,
Thank you very much for your request, in particular the explanation that nearly every single document produced by your project team.
However, without wishing to put words in Mr Alex Harris's mouth, I believe that his request was aimed at, in the original reply to my OIA request, MRP not revealing the precise section under which information was redacted in document RY12/065. Revealing which section such information was redacted under is OIA best practise.
Now that I have more information, I would like to confine my request. I would like to request from MRP all information available on the effect of MRP being taken out of the scope of the Official Information Act.
I would also ask that my request be treated with some degree of urgency (as under s12(3) of the OIA), given that MRP will likely fall outside of the scope of the OIA upon the passing of the Mixed Ownership Model Bill, and this bill is likely to be rapidly progressed after reporting from select committee. Although the deadline for response is before the reporting date of the bill, if a reply is late this would leave me with little time to appeal to the Ombudsmen if there is a refusal.
Yours sincerely,
Joshua Grainger
