Danny Pickering made this Official Information request to Ministry of Justice

The request was refused by Ministry of Justice.

From: Danny Pickering

Ministry of Justice,

Please also provide me with the following:
--The number of people who have received a “first warning” under the “three strikes law”, broken down by year. Please break this down further by ethnicity.
-The number of people who have received a “final warning” under the “three strikes law”, broken down by year. Please break this down further by ethnicity.
-The number of people who have received a “third strike” under the “three strikes law”, broken down by year. Please break this down further by ethnicity.
-The number of times the maximum penalty has been imposed on “third strikers”, broken down by year. Please break this down further by ethnicity.
-The average length of prison sentence per year, as far back as records permit. If possible, please provide me with the average prison sentence length broken down by ethinicity as well.

Ngā mihi,
Danny Pickering

Kia ora,

We have been asked to clarify one of your OIA questions:

The average length of prison sentence per year, as far back as records
permit. If possible, please provide me with the average prison sentence
length broken down by ethnicity as well.

We can only provide information on imposed sentences. If the requester
wants information on imposed sentences we could:

o for each year between 1980 and 2018, calculate each person’s longest
imposed prison sentence  (taking into account indeterminate sentences)
in that year
o categorise the sentence lengths into 3 groups aligned with the
Corrections/Parole groupings: 2 years and below, above 2 years,
indeterminate sentences (life and preventive detention)
o output tables for each year showing the ethnicity breakdown for each
of the 3 sentence length groups
o these tables would show the “number of convicted people with an
imprisonment sentence, by imposed sentence length and ethnicity, 1980
– 2018”.

Please advise if you would like to revise your question to imposed
sentences.

Many thanks,

Lydia.
