New Zealand Police

Dear William,

REQUEST FOR INFORMATION

Thanks for your official information request dated 18 January 2019 in
which you requested the following:

·          How many people have received formal warning for the
cultivation of cannabis?

·          How many people have received pre-charge warning for the
cultivation of cannabis?

·          How many people have received diversion for the cultivation of
cannabis?

·          How many people have been charged for the cultivation of
cannabis?

The table below shows the number of proceedings against offenders for the
offences of ‘Cultivate Cannabis’ and ‘Other Cultivation (Cannabis Only)’
for the years 2017 and 2018 broken down by the method by which offenders
were proceeded against.

+------------------------------------------------------------------------+
|Method of Proceeding | 2017 | 2018 |
|-----------------------------+---------------------+--------------------|
|Prosecution | 1071| 1032|
|-----------------------------+---------------------+--------------------|
|Formal warning | 42| 36|
|-----------------------------+---------------------+--------------------|
|Informal warning | 225| 195|
|-----------------------------+---------------------+--------------------|
|Alternative Action Plan | 8| 0|
|-----------------------------+---------------------+--------------------|
|Community Justice Panel | 0| 2|
|-----------------------------+---------------------+--------------------|
|Offender Deceased | 1| 0|
|-----------------------------+---------------------+--------------------|
|Youth Aid Section | 2| 0|
|-----------------------------+---------------------+--------------------|
|Total | 1349| 1265|
+------------------------------------------------------------------------+

Offences for cultivation of cannabis are excluded from the Police
pre-charge warning scheme, therefore, no individual is qualified for such
scheme under the said offences.

Police’s Adult Diversion Scheme requires an offender being charged before
a diversion scheme is offered. Police statistics do not distinguish
whether proceedings against offenders by prosecution (charged) include a
diversion scheme or not.

A proceeding counts each separate occasion when Police deal with an
alleged offender for one or more offences. The above table counts all
proceedings that include the offences for possession and use of cocaine
(irrespective of whether that was the most serious offence in the
proceeding). For statistical reporting purposes, proceedings are usually
classified according to the most serious offence on that occasion. This
offence might not be for possession and use of cocaine. Please note
therefore that these figures may differ to figures published elsewhere.

If you have any questions regarding this data, please feel free to contact
me via [1][email address] .

If you are not satisfied with my response to your request you have the
right to complain to the Office of the Ombudsman and seek an investigation
and review of my decision.

Yours sincerely,
