Dear Lakes District Health Board,
For the past 3 years, I request under the OIA Act:
1. all emails, documentation held by Lakes DHB and including all exchanges between the Ministry of Health and Lakes DHB in terms of emails, letters, contracts relating to smoke free and for smoking cessation contracts.
2.All statistics for Lakes DHB over the past 3 years relating to smoke free cessation for Maori.
3. The current status of smoking cessation contracts held by Lakes DHB, who are these with?, when?, and any new contracts from the Ministry of Health in the past 6 months to Lakes DHB.
4. For Mental Health:
Seclusion rates for Maori. It is alleged, that the reduction rates for Maori in seclusion is being considered as an aspiration only by Lakes DHB Mental Health Service, if this is the case then what confidence can anyone have for Maori patients and whanau receiving equitable services from this DHB?

Dear Shan Tapsell,
Your last response indicated that an oversight of knowledge and/ or awareness of the new contract for Tobacco control was made due to the timing of my oia and the lack of knowledge of existence of the contract by the person collating the info and info had not gone through all the Dhbs internal Lakes DHB systems when my oia was submitted to you in October 2018 and your later confirmation that Lakes DHB actually did have a contract in place in Sept 2018.
A subsequent oia to the MOH has confirmed two issues that have me questioning the integrity of the original response, given information provided by Lakes states that staff were advised it was the Ministry’s intention to not continue funding Lakes resulting in the disestablishment of the service and staff.
1. How do you explain the fact that discussions had already begun between the Ministry and Lakes Planning and Funding into new arrangements for the Lakes DHB tobacco control service to take a different approach In the very same month (June 2018) when the service and staff were being disestablished and the new contract was being planned.
2. Why was it advised in the information to staff by Planning and funding that it was the Ministry’s intention to not continue the contract when it is clear that the request was actually made by Karen Evison Director Strategy Planning and funding on 7/6/2018 to the Ministry quote ” we do not wish to have an extension we would like to have a new contract with a negotiated service specification”. Same month of service and staff disestablishments. This email from Lakes DHB Director strategy Planning and funding followed the Ministry’s earlier email offer on 7/6/18 stating “ this is a courtesy email to inform you that the Ministry intends to extend your DHB tobacco control contract for 12 months”.
