Car accident at around 1:25 pm on Saturday 21/07/2018 between Shortland St & High St, AKL CBD

Judy W. made this Official Information request to Auckland Transport

The request was refused by Auckland Transport.

From: Judy W.

Dear Auckland Transport,

Please kindly advise if the moment of impact was captured by any of your CCTV cameras nearby and how can our insurance company get hold of the accident footage?
The black Holden SUV rego KYB292 reversed out from High st and hit our white Toyota mobility van rego JMR288. The driver of the black SUV rego KYB292 claimed he didn't see our van while reversing resulting in this accident. And we wonder if it is legal AT ALL to reverse out from High st once you have turned into it??? We did have one disabled passenger onboard our van and we were all shocked. Our insurance company has already contacted the driver of KYB292 but he claimed he didn't see our van while reversing so he refused to admit liability. We are absolutely shocked as the driver of KYB292 is100% at fault.
Yours faithfully,

Judy W.

Dear Judy

The Auckland Transport Operations Centre (‘ATOC’) has reviewed our cameras and advised we do not hold any footage relevant to this accident as the camera was not facing in its direction and thus did not pick-up anything.

Your request is therefore refused under section 17(e) of the Local Government Official Information and Meetings Act 1987 (LGOIMA), as the footage requested does not exist.

Should you believe that we have not responded appropriately to your request, you have the right in accordance with section 27(3) of the LGOIMA to make a complaint to the Office of the Ombudsman to seek an investigation and review of the decision.

If you have any further queries, please contact us on 09 355 3553 quoting LGOIMA request number CAS-819074-B5J9T5.
