Dear Otago Regional Council,
I am writing to request the following information:
When bus operators for the Dunedin bus service fail to provide adequate service do they incur penalties?
By 'adequate service' I refer to the action of running buses to their set timetables within reasonable allowances for traffic and demand. For example, the 5:08 from City to Portobello on Monday, June 29th did not run, and the 8:25 on 2nd July to Ross Creek was 20 minutes late - neither of these services is adequate.
If there are penalties for failures, what are the nature of these penalties?

Thank you for your email.
Public Transport contracts between Otago Regional Council and transport operators provide mechanisms for Council to impose a financial penalty where, in Council's opinion, a reasonable level of service has not been maintained. An example could be the non-operation of a service where circumstances should have allowed that service to operate.
Alternatively, if a service did not operate due to reasons that in Council's opinion were out of the operator's control, for example a delay caused by a road accident or special event, then a penalty may not be applied.
The type of penalty applied will depend on the specific contract and can range from a fixed sum, or a per km rate, or liquidated damages - depending on the circumstances.
