Can you please provide me with all advice (emails, memos,manuals, orders, or writs) and correspondence your office holds on the legality of trespassing a client or a member of the public from MSD or WINZ buildings if that person has not committed a crime or offence?

Dear Mr Stewart 

 

Thank you for your request for information, dated 4 May 2018, seeking “
all advice (emails, memos, manual, orders, or writs) and correspondence
your office holds on the legality of trespassing a client or a member of
the public from MSD or WINZ buildings if that person has not committed a
crime or offence?”

 

The Ministry’s previous correspondence with you about  the Ministry’s
management of safety and security policies and practices in its sites
addresses many aspects, including the  entry of individuals on to Ministry
premises, the training of security guards and data about the number of
people trespassed from Ministry sites.

 

In November 2017 and March 2017, the Ministry wrote to you to advise you
that it is entitled to restrict access to its work places, and that it has
an obligation to ensure the safety of its workers and others who use it. 
 The principal source of this obligations is the Health and Safety at Work
Act 2015, which is available for you to access at:

.  There are no other documents in scope of your request.

 

You will aware that the Ministry provides options for people who have been
trespassed from its premises to continue to receive assistance by way of,
online facilities available to the public, and the Remote Client Unit. 
People who have been trespassed can also arrange for an Agent to undertake
their requests for assistance to the Ministry on their behalf. 

 

If you wish to discuss this response with us, please feel free to contact

Dear OIA_Requests (MSD),

Are you stating that this information isn't held by the Ministry and that trespassing as an option of dealing with clients wasn't discussed with your legal department, senior officials, or the Minister ?

You've misunderstood or deliberately misinterpreted my request. I've requested that you provide me with all advice (emails, memos,manuals, orders, or writs) and correspondence your office holds on the legality of trespassing a client or a member of the public from MSD or WINZ buildings including if that person has not committed a crime or offence?

Please also include any and all discussion documents (emails, memos,manuals, orders, or writs), legal advice, instructions from the Minister of Social Development, or Crown Law with regards to the subject of trespassing someone from a MSD or WINZ buildings.

Also FYI, despite your inference otherwise, I'm not currently trespassed from any MSD or WINZ buildings.
