information relating to the total number of protection order breaches.

 

The purpose of this email is to notify you that Police requires an
extension of time in which to respond to your request, pursuant to section
15A(1) of the Official Information Act 1982, because the request
necessitates a search through a large quantity of information and
consultations such that a proper response to the request cannot reasonably
be made within the original time limit.

              

Police require until 4 May 2018 to provide a substantive response to your

I refer to your Official Information Act (OIA) request dated 20 March 2018
in which you requested the following:

 

“Statistics of how many reported breaches of final protection orders per
year from 2000 to 2017, per gender. How many of the reported breached were

The below tables show the number of proceedings against offenders for
Breach of Protection Order for the period from July 2009 to December 2017.
Table 1 is broken down by year and sex of the offender. Table 2 is broken
down by year and method of proceeding.

A proceeding counts each separate occasion when Police deals with an
alleged offender for one or more offences. Proceedings are usually
classified according to the most serious offence for which the offender is
dealt with on that occasion. This offence might not be a ‘Breach of
Protection Order’ offence. The above figures present counts of all
proceedings involving at least one ‘Breach of Protection Order’ offence
irrespective of whether that was the most serious offence in the
proceeding. Please note therefore that these figures may differ to figures
published elsewhere.

 

Please note, Police data does not distinguish instances where breaches of
protection orders are dismissed due to insufficient evidence. ‘Not
Proceeded With’ is used in instances where it is decided not proceed
against an offenders for reasons such as insufficient evidence, where the
statute of limitation applies, diplomatic immunity etc.

 

Breach of Protection Order apprehension data for the period from 1994 to

Please note, these data are not comparable to the proceedings against
offender data.

 

Breach of Protection Order offences are as followed:

 

- Expand: ‘Offences against justice procedures, government security and
government operations’

- Expand:  ‘Breach of violence and non-violence restraining orders’

- Expand: ‘Breach of violence order’

·          Contravenes Protection Order (Firearm)

·          Contravenes Protection Order (No Firearm)

·          Fails to Comply With Conditions of Order (Firearm)

·          Fails to Comply With Conditions of Order (No Firearm)

·          Failed to Attend Program Sec.49A(1)

·          Other Breaches of Domestic Violence Act
