Dear Mr Michael Lucas

 

On 24 February 2018 you requested that the Earthquake Commission (EQC)
make available to you the following information:

 

‘All information held by Earthquake Commission including Scope of Works,
correspondence, documents and details of work carried out
- a breakdown of all payments made to date, for all claims.’

 

The timeframe for responding to your request is extended under section
15A(1)(a) of the Official Information Act 1982 – the request is for a
large quantity of official information or necessitates a search through a
large quantity of information and meeting the original time limit would
unreasonably interfere with the operations of the department or the
Minister of the Crown or the organisation.  You will receive a response by
23 April 2018.

 

You have the option of approaching the Office of the Ombudsman should you
wish.  The Ombudsman can be contacted at PO Box 10 152, Wellington 6143,

Dear Official Information Act Requests,

Am I correct in understanding that in EQC's reply message that EQC needs an extension of the time needed to meet legal obligations because EQC does not have all the files containing all of the requested information in one place?

Am I also correct in understanding that on the 23 April 2018 I will receive all files and information requested?

Is EQC also claiming this extension on the grounds that to find and give all the files and information requested about 227 Estuary Road, South New Brighton, Christchurch 8062 to Michael Lucas the owner of 227 Estuary Road, South New Brighton, Christchurch 8062 is unreasonably interfering with the operations of the EQC?

I can confirm that we extended the due date of your Official Information
Act (OIA) request as our OIA team is currently working through a very high
volume of requests.

 

Information related to your claim will be stored in a number of different
databases, as you have requested all correspondence and documents relating
to your claim.  This will mean our advisors will need to complete a
thorough search of each database to ensure you receive all relevant
information and fulfil our liabilities under the Official Information Act.

 

I can confirm however that you will receive your information request by

Dear Official Information Act Requests,

In the previous response it was CONFIRMED* I would receive the files on the 23/4 and now I am ASSURED* that you are treating this request with urgency while still not delivering the information requested.

*confirmed: verb
- state with assurance that a report or fact is true.
- make (a provisional arrangement or appointment) definite.

*assured: adjective
- protected against discontinuance or change.
- make (something) certain to happen.

As you can see by definition you are breaking the good faith of your own words. Your confirmation was not true or definite and your assurance nullified as change and uncertainty are the very things presented in your new response.

The stress caused to myself and loss of Mana as a Maori is unacceptable and is being amplified with each new delay.

I was given an in person qualification from the Honorable Annette King that as the owner of the property I should receive all information without delay.

With this in mind I ask when will I absolutely receive the information requested?
