Complaints about Police handling of unlawful sexual connection and rape complaints

Dear New Zealand Police,

I reside in New Zealand. I request information under the Official Information Act 1982.

I request information for the past 10 years of the number of complaints made to the Police and/or the Independent Police Conduct Authority about Police handling of unlawful sexual connection and rape complaints. I request information on number of complaints whether they are made to the Police or to the IPCA but investigated by the Police with the IPCA's supervision.

I ask that that these numbers by categorised both by year and further categorised by police district.

I also ask that this information be broken down into what kind of complaint is being made about the Police, be it Police misconduct, neglect of duty, Police practices, policies or procedures.

I also ask that the number of complaints about unlawful sexual connection and rape in which the cases were filed as a K3 "no offence disclosed" in which the complainant disputes or has expressed in their complaint that they disagree with this categorisation of their unlawful sexual connection and/or rape complaint.

While I do not expect any identifying details to be present in this information, should there be I ask that you redact identifying details to protect individuals privacy and still release the information.

With regards to the manner in which the information is released I request that any documents released be in an accessible, searchable format, i.e. no pdf's of scanned documents that would require transcribing and that would not be readable to people who rely on screen readers. And a spreadsheet format, such as CSV or XLSX, is preferable for tabular data. I also request that documents be uploaded online to fyi.org.nz website in response to my request rather than sent privately.

I request this information urgently and as a matter of public interest. For police to be publically accountable, the public must know the extent and frequency to which sexual assault related cases are handled in a way that would provoke a formal complaint. I ask that you release this information as soon as practicably possible and no later.

I have been asked to let you know that Police requires an extension of
time in which to respond to your request, under s15A(1) of the Official
Information Act 1982, because the request requires consultations such that
a proper response to the request cannot reasonably be made within the
original time limit.

                                                                                           

Police require until 29 March 2018 to provide a substantive response to
your request. 

 

You have the right to complain to the Office of the Ombudsmen about this
extension.

Frustrating to get a s18(g) response, especially after an extension. At a guess, perhaps Police thought they needed that extra time to check that the IPCA didn't hold that information?

I mean the police could have seen that I already requested from the IPCA and the IPCA linked me to some information that the police already had put together, which did not answer my request. And the IPCA isn't subject to the Official Information Act anyway, as both the IPCA and NZ Police have pointed out. Yes, it really is a bit poor form to request an extension in order to get more time only to send a refusal letter. 20 working days seems ample to write a refusal letter.
