I have read the link in your reply relating to Personal Hygiene. Can you please provide further information as to why an establishment that provides both a takeaway and dine in option was signed off by council as it was a building never used for food and beverage purposes previously so had to be signed off from an inspector before being granted a licence. They were then granted and approved a licence to trade. They have been advised by council that now they are not allowed to trade in the way they were when the licence was issued. Ie no longer able to dine in. Has there been a change in this Act in the last 14 months that would have changed their ability to trade?
If not then why was a licence given to trade as a takeaway & dine in outlet granted and approved in the first place?

Hi Carolyn
Thank you for your request for information relating to Food and beverage
outlets under the Local Government Official Information and Meetings Act
1987.
The original premises was always a food premises. Our records show it was
a butchers shop, then a vegetable shop and more recently a takeaway. The
takeaway business had evolved into a small diner that could accommodate
approximately 8 persons at the time of the last audit.
There may have been some confusion with regards to the terminology around
licensing and the selling of beverages? This premises was registered as a
health premises (not health licence), they are not required to have a
beverage / liquor license.
The past food inspections carried out by the Environmental Health Officer
(prior to Aug 2017) was for a food premises registration certificate and
in more recent times a food audit was carried out Aug 2017. As part of a
food audit an assessment is made on the food risk and safety. The toilets
under the Food Act are relevant to the staff only and not the customers.
I can confirm the Building department has issued no Building consents
(which came into effect after 1992) or a building permit (pre 1991) for
this premises.
The information we have on records is:
1) a permit for drainage & plumbing work in 1987;
2) A drainage as-built plan in 1970;
Both records are when the premises was a Butcher shop.
So while there were Health inspections for last year and the premise was
re-issued a health license, the complaint received triggered an
investigation by the building team.
As such the owner has been issued with a Notice to Fix that is required to
be complied with by the 29 March 2018. Compliance will be achieved by
either refraining from using the premises as a dine in or install
accessible toilet facilities to allow for the dine in. A building consent
is required for the latter.
