Dear Wairoa District Council,
I am writing to you to request information under the Official Information Act in regard to a private logging operation that was operating at 2 sites on Lake Road (State Highway 38) on the Tuai side of the Tarapatiki Bridge. Council were alerted to this activity by myself at a Hawkes Bay Regional Council submissions hearing on 12 June 2017.
Pine trees were removed from the landowners property by the logger and dragged across the public road to the road reserve on the other side where they were processed and then loaded onto logging trucks for removal. This process involved significant disruption to traffic.
Prior to moving from the first processing site it was cleared and left in a reasonable state as would be expected when using public land for private purposes.
When the logger left the second site he left behind a very large pile of logs/log ends and general forestry slash on the road reserve perched precariously above the Waikaretaheke river. He also spread forestry slash along the river bank for approximately 150-200 metres and into the river.

The information that I require from Wairoa District Council is as follows

1. Did the landowners or logging operator inform Wairoa District Council before starting the logging operation that they intended to use the road reserve as their log processing site and did Wairoa District Council authorise them to do so?
2. Did the landowners or logging contractor submit a Traffic Management Plan to Wairoa District Council?
3. Have the landowners or logging operator been given permission by Wairoa District Council to leave the logs/log ends and general forestry slash permanently on the road reserve?
4. I request a copy of all consents that were issued by Wairoa District Council to the landowners or logging operator for this work.

OFFICIAL INFORMATION REQUEST - AUTHORITY FOR LOGGING OPERATION ON ROAD
RESERVE AT TARAPATIKI, LAKE ROAD (STATE HIGHWAY 38), TUAI

 

Firstly, could you please acknowledge this email.

 

We are in receipt of your request for information dated 10 August 2017
which has been referred to our Engineering and Resource Consents
Departments for response. You have requested the following information
(responses in turn):

 

1. Did the landowners or logging operator inform Wairoa District Council
before starting the logging operation that they intended to use the road
reserve as their log processing site and did Wairoa District Council
authorise them to do so?

 

Permission was granted to stockpile processed logs for the purpose of
loading the logging trucks.

 

2. Did the landowners or logging contractor submit a Traffic Management
Plan to Wairoa District Council?

 

Yes

 

3. Have the landowners or logging operator been given permission by Wairoa
District Council to leave the logs/log ends and general forestry slash
permanently on the road reserve?

 

No – as per permit conditions attached – it has already been enforced by
WDC and arrangement for the material to be removed has been made.

 

4. I request a copy of all consents that were issued by Wairoa District
Council to the landowners or logging operator for this work.

 

A resource consent for this kind of activity is not required by the Wairoa
District Council and forestry activities are under the authority of the
Hawkes Bay Regional Council.

 

Please find attached permit application and approval forms attached for
the traffic management which also covers the approval to stockpile the
logs for the purpose of loading onto trucks, this is not for processing.

 

Please note if you are unhappy with the response to your request, you can
complain to the Ombudsman.

 

Under the LGOIMA, the Ombudsman can investigate:

 

•             decisions to withhold information or to delete information
from documents released to you;

•             delays or extensions to the time limits for responding to
requests;

•             charges for supplying information;

•             the way in which information has been made available;

•             release of information subject to conditions; and

•             the response to a request for a statement of reasons for a
decision affecting the requester.
