Point England Reserve as Ngati Paoa commercial redress

B Evans made this Official Information request to Minister for Treaty of Waitangi Negotiations

Response to this request is long overdue. By law Minister for Treaty of Waitangi Negotiations should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: B Evans

Dear Minister for Treaty of Waitangi Negotiations,
On what basis was part of Point England Reserve offered to Ngati Paoa as commercial redress when it is not a commercial property?

Yours faithfully,

B Evans

Dear C Finlayson (MIN),
In response to my OIA request 28th February, you state that:
1) “The site of Point England Reserve is of particular importance to Ngati Paoa.” Please explain in further detail – why is it of particular importance? What occupation did Ngati Paoa have specifically at Point England in 1840? Is their claim in association with the Tamaki Area generally, or is there some specific claim to Point England? If so, what?

2) “Crown landholdings in Tamaki are limited and there are few options available for commercial redress land.” My understanding is the Crown has $1.8 billion of residential land in the Tamaki Area, owned/controlled via the Tamaki Redevelopment Company. Therefore there would seem ample opportunity for commercial redress in the area without depriving the community of a beloved reserve. Why have these Crown landholdings not been used for commercial redress instead of Point England Reserve?

Yours sincerely,

B Evans
