I would like to request journey times from Panmure to Auckland CBD using car, bus and train at different times of day. I saw a line graph showing this information previously, however the data is from March 2015, so it is quite old. Is there more up-to-date information? If so please include it in your response to this request.

Thanks for your response. In my original request I also asked for bus times to be included in your response however the graph provided only has train and car. Please could you send through transit times for buses as well?

Initial thoughts are that:
* I agree with your position on providing access to the requester based on the logic you have already outlined. Whether the requester does not use this information as requested by AT is, of course, up to them.
* I think that if AT has accidently released information intended for the board that has not yet been presented to the board then it is reasonable to withhold it from public viewing until it has been presented to the board if this is done within a reasonable timeframe.
* A reasonable time would be within another 20 working days on the basis that AT could have alternatively asked for such an extension under LGOIMA instead of releasing it as they have.
* If the information is not presented to the board with a reasonable timeframe then it should still be made public because it was, in the end, released. I do not get any sense that AT wish to withhold releasing the requested information, just that it was released too early.
* Also, it is important that the requester and public (and FYI) not be held in limbo on accessing this response as this delays triggering the Ombudsman complaint process (for example if the response contained redacted information that should have been released).
* delayed release is always better than no release

I have republished the response, as I do not consider AT's request to be reasonable given it was already overdue at the time of receipt, and there are no privacy or accuracy reasons given.

A response was received from AT today that they advise was sent prematurely. AT have asked for it to be removed. The authority's reason is not one that we have a policy on handling. I have decided the following:
1. Continue to allow the requester to access the response. This is on the basis that if the requester had made the request directly to the authority, they would be in possession of it. The decision how to handle the information is up to the requester.
2. Hide the response from public view while I make a decision on whether AT's request is reasonable, and to make that decision by midday tomorrow. My understanding is that the response had not been presented to the AT board to approve release. OIA 15(2) requires authorities to make a decision on release "as soon as reasonably practicable, and in any case not later than 20 working days". As today's response is already 4 working days overdue, my initial reaction is that further delay is unreasonable and that I will republish the response tomorrow.
As we do not have a policy on this, feedback from users is welcome (to requests@fyi.org.nz if you wish your comment to remain private.)
