Under LGOIMA, your request must be dealt with as soon as is reasonably
practicable and in no case later than 20 working days after the day on
which the request is received.  20 working days excludes Saturdays and
Sundays.  On this basis, we calculate a response to your request received
on 1 February 2017 is due by Wednesday 1 March 2017, at the latest.  We
shall of course endeavour to process your request as quickly as staff
resources allow.

 

There may be a charge for the staff time in collating the information
requested.  Under our charging policy, staff time for the first hours is
free of charge.  Thereafter this will be charged at the prescribed rate of
$38 (GST inclusive) per half hour.  In addition, there will be
photocopying charges at 20c per sheet, with the first 20 pages being
copied free of charge.  Under clause 13(4) of LGOIMA we do have the
ability to request the amounts due are paid in advance of the release of
information.

 

Finally, I need to advise you of your right to complain to an Ombudsman if
you do not believe you have been given a reasonable response to your
request.  This right to complain is dealt with in section 27 of the Local
Government Official Information and Meetings Act.

I just need to clarify some parts of the request.

 

The Tasman District Council is responsible for the Moutere Highway so we
can only provide information relating to Traffic Management Orders 
covering the Temporary Speed Limit in the area of  the Moutere Highway.
You will need to apply separately  to the New Zealand Transport Agency
(NZTA) for information relating to the Appleby Highway.

 

Is it just the Moutere Highway you are after this information for?

was initiated by NZTA for the section on the State Highway and extended to
cover Cottrell Road and the section on the Moutere Highway.

 

The 80km/hr speed limit was made permanent on the Moutere Highway section
and Cottrell Road during the by law review which came into effect on 1
April 2016.

Further to your request, please find below our response:

 

In response to a recommendation by NZTA to reduce the speed limit on the
State Highway, Tasman District Council approved a Traffic Management Plan
for the positioning of signage to support a temporary 80km/hr speed limit
on adjacent parts of the Moutere Highway and Cottrell Road.  This was put
in place on 3 October 2014 and ran until 4 October 2015.

 

This was then renewed and extended from 28 September 2015 to 28 March 2016
and renewed from 1 April 2016 until 1 April 2017.

 

After a public consultation process Council adopted changes to the Speed
Limit Bylaw on 18 February 2016 and changes came into effect on 1 April
2016 – one of these changes was making the 80km/hr temporary limit a
permanent speed limit for the relevant sections of the Moutere Highway and
Cotterell Road.

 

There is no information held regarding ‘Traffic Management Orders’. 

 

You have a right to complain to an Ombudsman if you do not believe you
have been given a reasonable response to your  request.  This right to
complain is dealt with in section 27 of the Local  Government Official
Information and Meetings Act.

shall of course endeavour to process your request as quickly as staff

There may be a charge for the staff time in collating the information 
requested.  Under our charging policy, staff time for the first hours is 
free of charge.  Thereafter this will be charged at the prescribed rate of

$38 (GST inclusive) per half hour.  In addition, there will be 
photocopying charges at 20c per sheet, with the first 20 pages being 
copied free of charge.  Under clause 13(4) of LGOIMA we do have the 
ability to request the amounts due are paid in advance of the release of 
information.

 

 

 

Finally, I need to advise you of your right to complain to an Ombudsman
if  you do not believe you have been given a reasonable response to your 
request.  This right to complain is dealt with in section 27 of the Local 
Government Official Information and Meetings Act.
