As the Landlord and the Director of the New Zealand Registered Company/Owner of the property 95 Milton Road in Napier I am requesting to be informed if a search warrant was executed upon the tennanted property 95 Milton Road during the months of October or November in 2016. And if so I'd like to request a copy of the search warrant details be made available to myself

I refer to your request of 28 December 2016 in which you asked “to be
informed if a search warrant was executed upon the tennanted property 95
Milton Road  during the months of October or November in 2016. And if so

This response from Police is curious and a bit disingenuous.

Releasable information is either official (releasable publicly under OIA) or private (releasable to the subject of the information under the Privacy Act). However she did not mention they are handling this as a Privacy Act request at all.

Private information is supposed to be withheld under the OIA. It is not an excuse to avoid an entire response being published.

If you would prefer the information to be published online, you are entitled to receive the information "in the way preferred" (e.g. through FYI.org.nz) under section 16(2) OIA.

I had a email reply direct from the police saying there was no information of any search warrants acted on in the date time i specified . I realised I had asked for information on the wrong two months in 2016 and asked for the same request be made for the two months prior to what I had asked for . He replied there had never been a search warrant that was acted on at this address. I informed him he had made a mistake as I was present during a search warrant on that address some years earlier . I asked if the officer could change his search criteria and check history in the two months prior to the ones on my application thru the official informations act as I had made a mistake and I never got a reply from him.
