Dear Ms Sutherland

 

Thank you for request of 19 July 2016. As you are aware, the Ombudsman is
not subject to the Official Information Act 1982 (OIA), however, this
Office endeavours to comply with the spirit of the legislation, unless we
are unable to do so.

 

You have sought ‘a list of all overdue OIA requests made for each
government department as at 19 July 2016.’ Regrettably, the Ombudsman does
not hold information of this nature. This Office only holds information
relating to the complaints we have received ie, delay complaints. However,
I would note that in former Chief Ombudsman Dame Beverley’s own motion
investigation report entitled ‘Not a game of hide and seek’ the following
recommendation was made:

 

My Office should work with agencies to develop a standardised model for
data collection of OIA requests to enable high quality analysis and
compliance.

It would be open to you to request this information from any agency which
is subject to the OIA directly.

 

You have also sought ‘the current number of complaints outstanding for
each government department, and a break down of what each complaint

Before, responding to this aspect of your request, it would be helpful if
you could please clarify a couple of matters:

 

·         By ‘government departments’ do you mean the government
departments listed in Schedule 1, Part 1 of the Ombudsmen Act 1975 ie,

·         Can you please confirm whether you are seeking information about
Official Information Act 1982 (OIA) complaints only?

Thank you for the clarification you have provided, it is appreciated. I
understand that you are seeking information about OIA complaints
concerning government departments (listed in Schedule 1, Part 1 of the
Ombudsmen Act 1975). I will respond to each aspect of your request in
turn.

 

The number of OIA delay complaints received across all departments for the
period 1 July 2015 - 30 June 2016.

 

In 2015/16 we received 111 OIA ‘Delay Deemed Refusal’ (section 28(4) of
the OIA) complaints against the below agencies. Please note that we are
currently in the process of reviewing the integrity of our data for our
2015/16 Annual Report, so it is possible that this table may include a few
minor inaccuracies.

As at 30 June 2016, we had 32 open (ie, ‘unresolved’) OIA ‘Delay Deemed
Refusal’ (section 28(4) of the OIA) complaints against the above agencies.
By way of context, 12 of these complaints were less than a month old as at
30 June 2016.
