Dear Minister for ACC,
I note that the Injury Prevention, Rehabilitation, and Compensation (Review Costs and Appeals) Regulations 2002 legislation only applies to reviews and appeals.
The ACC through Fairway Resolution Limited offers ACC claimants other mechanisms of dispute resolution e.g. mediation and conciliation, however, costs associated with any form of alternative dispute resolution cannot be claimed by ACC claimants who want to try these other methods before reviewing ACC decisions. Therefore the ACC is focussed on the adversarial system of dispute resolution rather than the cooperative system of dispute resolution. Please provide me with information under the Official Information Act as to why this is the case, and why costs associated with mediation and conciliation cannot be claimed from the ACC?

As an adjunct to my original information request in relation to ACC review and ADR costs and expenses claimable under Injury Prevention, Rehabilitation, and Compensation (Review Costs and Appeals) Regulations 2002, can you please advise me under the Official Information Act whether or not "Other expenses reasonably incurred by applicant or another person, or on behalf of an applicant or other person, associated with a hearing (for example, transport to a hearing or time off work for an applicant, another person, representative, or a witness or support person such as whanau support; disbursements such as photocopying, childcare, or telephone charges ..." claimable in relation to review hearings are claimable in relation to claimants needing to attend ACC directed, arranged and funded assessments by doctors/specialists/assessors.
In other words, what expenses does the ACC pay where claimants are required to attend ACC assessments?
