Section 133(5) of the AC Act

Lee M. made this Official Information request to Minister for ACC

Response to this request is long overdue. By law Minister for ACC should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: Lee M.

Dear Minister for ACC,

Section 133(5) of the AC Act provides; "If a person has a claim under this Act, and has a right of review or appeal in relation to that claim, no court, Employment Relations Authority, Disputes Tribunal, or other body may consider or grant remedies in relation to that matter if it is covered by this Act, unless this Act otherwise provides."

Under the Official Information Act please advise me --- where in the Act does it provide that Fairway Resolution Limited "may consider or grand remedies in relation to that matter .if it is covered by this Act? Or, where in the Act does it provide otherwise?

Yours faithfully,

Lee M.

From: Lee M.

Dear Minister for ACC,

I refer to the reply dated 10 May 2016 posted above.

I also refer to the written and signed authority provided by my wife and copied to the ACC and its lawyers that empowers me to communicate with both aforementioned bodies on her behalf.

My wife has not received a response from M.B.I.E. I am now amending her original request and replacing it with the following new request under the O.I.A.:

Section 133(5) of the Accident Compensation Act provides; "If a person has a claim under this Act, and has a right of review or appeal in relation to that claim, no court, Employment Relations Authority, Disputes Tribunal, or other body may consider or grant remedies in relation to that matter if it is covered by this Act, unless this Act otherwise provides."

Please provide me with copies of the relevant parts and sections of the Accident Compensation Act that provides for Fairway Resolution considering or granting remedies under the Accident Compensation Act where there are rights of review or appeal in relation to claims. Or, please provide me with the links to the relevant parts and sections aforementioned.

Yours faithfully,

Husband of Lee M.
