Why does the ACC's Office of Complaints Investigator refuse to investigate?

Lee M. made this Official Information request to Minister for ACC

Response to this request is long overdue. By law Minister for ACC should have responded by now (details and exceptions). You can complain to the Ombudsman.

From: Lee M.

Dear Minister for ACC,

Section 39, sub-clauses (b) and (c), of the AC Act, and, Part 1, sub-clauses 1.5.(b) and (c) of the schedule that attaches to the ACC Code of Claimants Rights, both state that the definition of the ACC in the Code includes "a person acting as an agent of the Corporation" and "a person who provides services (excluding treatment) to claimants on behalf of or authorised by the Corporation."

Fairway Resolution Limited provides mediation and review services to claimants on behalf of and with the authorisation of the ACC. This makes Fairway Resolution Limited subject to compliance with the ACC Code of Claimants Rights, yet, the ACC's Office of the Complaints Investigator refuses to investigate complaints made by ACC claimants about administrative and procedural problems that they experience in their dealings with Fairway Resolution Limited, and where they fall under the Code of Claimants Rights.

Can you please provide me - under the OIA - with all relevant information that relates to the ACC's decision not to investigate complaints made by ACC claimants about administrative and procedural problems that they experience in their dealings with Fairway Resolution Limited, and, that saw the ACC decide that Fairway Resolution Limited does not need to comply with Section 39, sub-clauses (b) and (c), of the AC Act, and, Part 1, sub-clauses 1.5.(b) and (c) of the schedule that attaches to the ACC Code of Claimants Rights.

Yours faithfully,

Lee M.

Dear N Kaye,

I appreciate the high volume of correspondence received by the Minister, however, it is not the MInister that replies to information requests but a special office within the ACC especially set up for this purpose. I have not heard from them regarding an extension and this reply of yours is not acceptable as it does not request an extension and also does not give me any indication of when I might receive the requested information.

Yours sincerely,

Lee M.

From: Lee M.

Dear Government Services,

You advised me in your letter of response for which I thank you:

"In addition, no administrative decision was made as to whether or not Fairway Resolution Limited needs “to comply with Section 39, sub clauses (b) and (c), of the AC Act, and, Part 1, sub clauses 1.5.(b) and (c) of the schedule that attaches the ACC Code of Claimants Rights”. This is because Fairway Resolution Limited is an independent, Crown-owned company that works with clients to prevent, manage and resolve conflict. As set out in the relevant legislation, Fairway Resolution Limited is not subject to the Code of
ACC Claimants’ Rights".

Under the Official Information Act I am requesting that you please provide me with a copy of the "relevant legislation" that supports your advice that "Fairway Resolution Limited is not subject to the Code of ACC Claimants' Rights".

Yours sincerely,

Lee M.
