District Court interpretations of new Harmful Digital Communications Act offence

Response to this request is long overdue. By law Ministry of Justice should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

Dear Ministry of Justice,

I am requesting copies of judgments and related documents issued by the District Court in relation to the new offence under the Harmful Digital Communications Act 2015. I understand that at least four people have already been sentenced under the Act and that a number of others are in front of the courts at present.

My principal interest in these documents is to determine how judges have initially interpreted the meaning of "harm" as it is incorporated into the offence. I am currently completing my LLB(Hons) dissertation at the University of Auckland and my aim is to discuss local and international approaches to balancing the right to freedom of speech against the right of individuals to be free from harm.

I would appreciate any assistance you can offer in this matter.
